Devizes Cricket Club Constitution Revised 10th November 2003.
Name of Club
1: The Club shall be called Devizes Cricket Club and will be affiliated to the England and Wales Cricket Board.
Aims and Objectives
2: The aims and objectives of the club will be :
- To offer coaching and competitive opportunities in cricket.
- To promote the club within the local community and cricket.
- To provide, develop and manage the Devizes Cricket Club and its own facilities for the playing and administration of cricket and the provision of social amenities connected therewith.
- To ensure a duty of care to all members of the club.
- To provide all its services in a way that is fair to everyone.
- To ensure that all present and future members receive fair and equal treatment. The club will, at all times, seek to extend its facilities to all gender, youth and minority groups.
Trustees
3: The whole of the real property of Devizes Cricket Club shall be vested in a body of four Trustees, who shall deal with and otherwise administer the same in accordance with directions given to them, from time to time, by the Committee constituted as hereinafter provided.
4: Full membership of the Club shall be a necessary qualification of a Trustee.
5: Vacancies in the body of Trustees, however arising, shall be filled by ordinary resolution of the Committee with such appointment to be confirmed at the next Annual General Meeting
6: All Trustees shall be entitled to be indemnified out of the assets of the Club, against all costs, losses, damages, claims and demands which may arise or be made against them, or any of them, by reason or on account of any dealing by them with the property of the Club in pursuance of any direction given to them by the Committee, whether such dealing shall or shall not be one which Trustees are by law empowered to do.
Management
7: The Club shall be under the management and direction of a Committee appointed as hereinafter provided.
8: The officers of the Club shall be the President, the Chairman, the Secretary, The Treasurer and the Club Captain.
9: The Committee of the Club shall consist of the Officers of the Club together with the Fixture Secretary, the Membership Secretary, the Youth Manager, the Players Sub-Committee Representative, the Grounds Sub-Committee Representative, the Development Sub-Committee Representative, the Fund Raising Sub-Committee Representative and the Sports Club Representative.
The Officers and the Committee shall be elected, by the Club, at the Annual General Meeting. All officers and committee members will retire each year but will be eligible for re-election.
10: Vacancies in the body of the Committee of the Club, however arising, shall be filled by ordinary resolution of the Committee with such appointment to be confirmed at the next Annual General Meeting.
11: The following Captains and Vice Captains shall be elected at the Annual General Meeting. The Saturday 1st X1 Captain and Vice Captain, the Saturday 2nd X1 Captain and Vice Captain, The Saturday 3rd X1 Captain and Vice Captain, the Saturday 4th X1 Captain and Vice Captain. The Sunday 1st X1 Captain and Vice Captain, the Sunday 2nd X1 Captain and Vice Captain and the Mid Week Captain.
12: Vacancies in the body of Team Captains and Vice Captains, however arising, shall be filled by ordinary resolution of the Committee with such appointment to be confirmed at the next Annual General meeting.
13: Nominations for the posts of Officers of the Club, Committee Members, Captains and Vice Captains to be submitted in writing to the Secretary no later than 31 days prior to the Annual General Meeting.
14: The Committee shall meet once every month during the playing season of the Club and at least three times during the close playing season. The quorum at any Committee Meeting shall be five members of the Committee actually present in person.
15: In the event of a tied vote, the Chairman shall cast the deciding vote.
16: The Committee shall manage the Club and shall be empowered to appoint, from time to time, as the Committee shall deem necessary, such Sub-Committees for such purposes and with such powers as may be required. No Sub-Committee shall have executive powers except by specific resolution of the Committee.
Membership
17: All members will be subject to the regulations of the constitution and by joining the club will be deemed to accept these regulations and codes of conduct that the club has adopted.
18: Members will be enrolled in one of the following categories :
Life Member. Vice President. Adult player. Student player 18 and over. Youth /junior player under 18. Family Membership. Non Playing Member and Social Member.
19: Candidates for election to membership of the Club shall sign a formal application for membership of the Cricket Club and the Sports Club upon a form to be obtained from the Membership Secretary and shall be proposed and seconded by members of the Club both of whom must be personally acquainted with the candidate and responsible for his or her eligibility. The Membership Secretary shall post the application, duly signed, in the Club premises endorsed with the date upon which the application reached him. The name of each candidate shall be brought before the Committee at their next meeting to be held at least ten days after the posting of the candidates name and he or she shall be elected or rejected by the majority of those voting. Any member of the Committee who is unable to be present at the meeting may vote in writing, such vote to be delivered to the Membership Secretary at least three days before the meeting.
20: Rates of annual subscription and match fees shall be determined from time to time by the Committee.
21: A candidate who shall fail to pay his or her annual subscription within one month from the date of the Membership Secretary’s notice advising election shall thereupon render his or her election null and void.
22: All annual subscriptions are payable by the 31st day of May in each year. A list of all members in arrears shall, after application in writing has been made to him or her, be posted in the Club premises on or after the 30th day of June annually. Any member whose name is posted shall cease to exercise any of the privileges of membership and he or she may, at the discretion of the Committee, be removed from membership of the Club but may be re-instated with their consent and payment of all arrears.
23: In case the conduct of any member either on or off the Club premises shall appear to the Committee to endanger the character, interest or good order of the Club, or if any members shall wilfully infringe any of the rules or regulations made from time to time for the government of the Club, the Committee shall be specially summoned to consider the case. The member concerned shall be informed by the Secretary of the date, time and place of the meeting of the Committee and shall be invited to attend for the purpose of giving any such explanations as may seem proper to him or her. If the member complained of shall not explain his or her conduct to the satisfaction of the Committee, they may call upon him or her to resign and if he or she shall not do so within one week from the time of being so called upon, the Committee may expel the member and in either case his or her name shall be erased from the list of members and he or she shall not afterwards be admissible upon the Club premises, nor shall he or she be eligible for re-election.
Visitors
24: Members may introduce visitors subject as follows:
a: The visitors’ name and address must be entered in the Sports Club visitors book together with the name of the introducing member.
b: No person who has been rejected as a candidate for admission to the Cricket Club or Sports Club as a member shall be admitted as a visitor.
c: Visitors may use the Clubhouse when accompanied by a member without payment and during such visit shall abide by the rules of the Cricket Club and the Sports Club.
d: Sports Club regulations apply to the number of visits permissible by any one individual.
25: A member or official of a team visiting the Club in connection with any game of cricket or official business at the Club’s premises, shall become a temporary member for the period of that visit only. Such temporary member shall be entitled to the privileges of membership for the period of his or her visit only but shall not introduce a visitor nor attend or vote at any meeting of the Club.
Meetings
26: An Annual General Meeting shall be held not later than the 30th day of November in each year. Notice thereof shall be given to the members by circular at least fourteen days before the date of such meeting.
27: An Extraordinary General Meeting shall be called by the Secretary upon direction of the Committee in accordance with such direction and upon a requisition stating the special objects thereof signed by at least twenty members of the Club entitled to attend and vote at a General Meeting, or one fifth of the total number of the members of the Club so entitled. Whichever is the least. Such meeting shall be held not less than fourteen nor more than twenty-one days from the date of the receipt by the Secretary of the requisition. Notice of any Extraordinary General Meeting and the object for which it is called shall be given to the members by circular at least ten days before the date of such meeting. No other business than that named in the notice shall be put before an Extraordinary General Meeting.
28: Each member shall be entitled to one vote at any General Meeting upon each and every matter put to the vote.
Alteration In Rules
29: These rules may be altered at any time but no new rules or alteration of any original rules shall be made without the sanction of the Annual or Extraordinary General Meeting at which there shall be present not less than twenty members of the Club entitled to attend and vote, or one fifth of the total number of the members so entitled whichever is the least. Ten days at least of such proposed new rule or alteration of an original rule defining the same shall be posted in one of the public rooms of the Clubhouse.
Miscellaneous
30: All complaints shall be made in writing to the Secretary. If the Secretary is unable to deal with a complaint, he shall submit it to the next meeting of the Committee whose decision shall be final. The Secretary shall report all complaints and any action taken to the Committee.
31: Dogs, except guide dogs, shall not be admitted to the Clubs grounds. |
